Replacing Enduring Power of Attorney (EPA) with a Lasting Powers of Attorney (LPA)

In England and Wales, Enduring Powers of Attorney (EPAs) were replaced by Property and Financial Affairs Lasting Powers of Attorney (LPAs) in 2007, following the introduction of the Mental Capacity Act 2005.

Some reasons to consider changing to an LPA are;

  • Registration is only needed when the person making the EPA has become (or is becoming) mentally incapable of managing their affairs. Delays in helping the person can occur due to the time to register.
  • EPA's do not allow for the delegation of health and care decisions.
  • The EPA process can be open to abuse.

* Fees as of March 2021, these may change in the future.
